Thomas Jefferson, president from 1801 to 1809, resisted a subpoena to give evidence at the 1807 treason trial of his one-time vice-president Aaron Burr. He eventually produced relevant papers. In modern times, President Nixon defied subpoenas before resigning in 1974 as a result of the Watergate scandal. No sitting president has ever testified in court in a criminal trial, although Mr Reagan will have left office when the hearing starts on January 31. Constitutional law experts say a former president is in a much weacdr position because it is not the man but the office which is protected.
